Terms of Service

These Terms of Service ("Terms") govern the use of the BaptiDay mobile app and website (the "Service") published by WINDFALL. By creating an account or using the Service, you accept these Terms without reservation.

2. Service description

BaptiDay is an app for individuals that helps plan baptisms and family events: guest management, budget, invitations, moodboard, checklist, and transactional notifications.

The Service is intended solely for consumers within the meaning of the French Consumer Code. It is not intended for professional use.

3. Access and registration

  • Using the Service requires creating an account (email + password, Sign in with Apple, or Google account).
  • You must be at least 15 years old. Minors under 15 must obtain their legal representatives' authorisation.
  • Information provided at registration must be accurate, complete and kept up to date.
  • You are responsible for the confidentiality of your credentials and for all actions taken through your account.
  • The Service is available 24/7, subject to potential maintenance, updates or force majeure interruptions.

4. Subscriptions and pricing

BaptiDay offers a free plan with limited features and paid premium subscriptions unlocking all features.

  • Current pricing is displayed in the app before any purchase. Prices include applicable VAT.
  • Subscriptions are managed by the App Store (Apple) or Google Play (Google) depending on your platform. Payment is charged to the associated iTunes / Google account.
  • Subscriptions auto-renew at the end of each billing period, unless cancelled at least 24 hours before the end of the current period.
  • Management and cancellation are performed from your App Store or Google Play account settings (not from BaptiDay).
  • No refund can be granted directly by BaptiDay: requests must be addressed to Apple or Google following each platform's procedure.

5. Right of withdrawal

Under Article L221-18 of the French Consumer Code (and equivalent EU rules), you have 14 days from the subscription date to exercise your right of withdrawal.

6. User content

You remain the sole owner of the content you publish on the Service (photos, text, guest lists, etc.). You grant us a non-exclusive, royalty-free, worldwide licence, limited to the duration of the Service, to host, display and transmit this content to the recipients of your choice as part of the Service delivery.

You warrant that you hold all necessary rights in the content you publish (notably image rights of depicted persons) and undertake not to publish:

  • unlawful, defamatory, insulting, racist, discriminatory, violent or pornographic content;
  • copyright-protected content without authorisation;
  • third parties' personal data without their consent;
  • unsolicited commercial or advertising content.

Any content reported as unlawful may be removed without notice and the associated account suspended.

7. User obligations

You undertake to:

  • use the Service fairly, in accordance with its purpose and these Terms;
  • not infringe third-party rights or applicable laws;
  • not attempt to bypass security measures, degrade, overload or disrupt the Service;
  • not perform scraping, reverse engineering, or mass data extraction;
  • inform the guests whose contact details you record of the data processing (see Privacy Policy, section 7).

8. Intellectual property

The Service, its interfaces, features, source code, graphics, the "BaptiDay" trademark and all elements making it up are the exclusive property of WINDFALL or its partners, and are protected by intellectual property law.

Any reproduction, representation, adaptation, modification, translation, publication or exploitation, in whole or in part, by any means whatsoever, without prior written authorisation is strictly prohibited and constitutes infringement (Art. L335-2 ff. French Intellectual Property Code).

9. Liability

WINDFALL does everything possible to provide a quality Service but cannot guarantee uninterrupted availability or the complete absence of errors. Our liability cannot be incurred:

  • for misuse of the Service or breach of your contractual obligations;
  • for unavailability due to force majeure, a third-party sub-processor outage, maintenance operations or any cause beyond our control;
  • for indirect damages (loss of business, loss of opportunity, reputational damage, etc.);
  • for content published by users or third parties;
  • for third-party services (Apple, Google, Supabase, etc.) over which we have no control.

In accordance with mandatory consumer protection rules, our liability cannot be limited or excluded in cases of wilful misconduct, gross negligence or personal injury.

10. Legal guarantee of conformity

Under Articles L217-3 ff. of the French Consumer Code, you benefit from the legal guarantee of conformity applicable to digital content and services. This guarantee allows you to obtain the Service's conformity at no cost when it presents a defect.

11. Termination

You may delete your account at any time from the app (Profile → Settings → Delete account) or by writing to us at hello@bapti.day.

In case of serious breach of these Terms — including fraudulent, unlawful behaviour or behaviour infringing third parties' rights — we may suspend or terminate your account without notice or indemnity, without prejudice to any damages we may claim.

12. Personal data

Processing of your personal data is described in our Privacy Policy.

13. Consumer mediation

Under Article L612-1 of the French Consumer Code, you may refer your dispute free of charge to a consumer mediator if it cannot be resolved directly with us.

14. Changes to the Terms

We reserve the right to modify these Terms at any time. Substantial changes will be notified by email or in-app notification at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.

15. Governing law and jurisdiction

These Terms are governed by French law. In case of dispute, the parties will seek an amicable resolution.

Failing that, the French courts will have sole jurisdiction. Under mandatory consumer protection provisions, you retain the possibility of bringing your action before the courts of your place of residence within the European Union.
